General Terms and Conditions for Bicycle Rental Operated by Eco Sports Limited.
These general terms and conditions apply to the use of all rental bicycles provided by Eco Sports Limited and operating in the Republic of Malta, including Gozo and Comino and all other areas where these terms and conditions may apply legally. The customer takes full responsibility for all bicycles hired out under this agreement, as well as for all persons using the bicycles.
Terms and Conditions of Use, Assumption of Risks and Liabilities
● The customer is required to allow us to take a photo copy of your passport and another ID document.
● The customer must be over 18 years of age to enter into this rental agreement.
● Rental bicycles may not be used:
- By persons who are younger than 18 years old, unless accompanied by an adult.
- By persons who have little or no cycling experience.
- To carry other persons (excluding small children who must be strapped into a bicycle child seat, mounted onto the bicycle).
- To transport flammable, explosive, toxic or dangerous materials or substances.
- To sub-rent to third parties.
- In strong wind or stormy weather.
- Under the influence of alcohol or drugs.
● All customers hiring bicycles are expected to be able to cycle safely on public roads and be able to follow and obey all road traffic safety laws and regulations, in particular the rules for cyclists.
● It is strongly recommended that customers wear appropriate safety equipment whilst cycling, including helmet and clothing which will make them clearly visible to others both in daylight and in lowlight conditions.
● The customer must ensure that all transported goods and items are fastened and/or secured properly at all times.
● The customer must ensure that the bicycles are parked safely, other vehicles and or traffic is not obstructed and that no damage is done to third parties or property thereof. In particular, it is not permissible to park bicycles at traffic lights; parking ticket machines; traffic signs; walkways that are thereby reduced to a width of less than 1.5 meters; in front of, in, or near emergency exits or fire service zones and where the bicycles cover local advertisements.
● The customer is obliged to inspect that the bicycles are in roadworthy and safe condition before rental. Should the customer find technical defects at the beginning of, or at any point during the rental period, he/she is to immediately stop the use of the bicycle and notify Eco Sports Limited. A replacement bicycle will be issued.
● Unauthorized modifications or alterations to the bicycles are not allowed. Modifying or exchanging original parts of the bicycles will be penalized and a fee will be charged on account of replacement parts required.
● In the event of any damages to the bicycles, Eco Sports Limited must be notified immediately.
● It is the customers responsibility to repair tyre punctures. If assistance is required, a call out fee may be charged.
● Eco Sports Limited calculation of all fees and services is charged on the basis of the prices valid at the beginning of each individual use of a bicycle.
● The user is obliged to pay the billed rental amount by means of either cash, credit/debit card or by electronic transfer before receiving the bike or E-bike and all supplied equipment.
● If the rental period is reduced for any reason, the customer will forfeit 50% of the remaining paid days. The remaining 50% payment will be refunded to the customer.
● Eco Sports Limited is entitled to request a cash security deposit for hire and damage, including third party damage, upon hire. A valid driver’s license or ID is accepted in place of the cash security deposit, only if agreed upon by the customer.
● In the event of any dues or damages, Eco Sports Limited will be entitled to forfeit, in his favour, the customers cash security deposit. For the customer to avoid any additional fees due to repair, maintenance or replacement, Eco Sports Limited must receive the bicycles and all supplied equipment in a satisfactory condition (clean and undamaged), and on the agreed upon date and time. Undamaged condition means normal wear and tear, but does not include broken spokes and rims, bent rims, damaged frames, handlebars, seats or other parts from misuse and/or crashes. Damaged parts or components will be repaired/replaced. The customer agrees to pay regular labour rates and retail prices for components replaced.
● If an ID/Driver’s license is supplied in place of the cash security deposit, the customer will be required to pay for any dues or damages before the ID/Driver’s license is returned to the customer.
● Late returns will be billed according to the daily rate and the security deposit/ID/Driver’s licences will be returned to the customer once the outstanding balance is paid.
● A helmet, lock, repair kit and pump are provided at no extra cost. Bicycle keys, power supplies, spanners will be supplied if needed, at no extra cost.
● Lights are provided upon request or the customer may use his/her own lights, if planning to ride in low light conditions.
● Child seats provided upon request at an additional charge, have a 22kg max weight limit. The customer must ensure the child seat is correctly fitted before each use and the child is correctly buckled in.
● To prevent theft, all bicycles will be provided with a lock, which must be used every time the bicycle is left unattended. The bicycle should be locked against a secure fixture which does not allow it to be lifted over or off the fixture.
● The bicycles must be locked indoors when not in use overnight.
● In case of bicycle theft or an accident involving not only the user, but also third parties or their property, the user must report the incident to both the police and Eco Sports Limited immediately. Eco Sports Limited must be provided with the police accident report as soon as this is available.
● Eco Sports Limited has the right to charge the customer for any lost/stolen/unreturned equipment at the current retail price per item.
● The customer is responsible for any official fines incurred as a result of noncompliance with these or local regulations.
● The customer accepts liability for any damages resulting from theft of or damage to the bicycles from the moment of receiving the bicycles until successful return of the bicycles to Eco Sports Limited. This liability shall amount to the specific material and labour costs up to but not exceeding the full replacement cost of the bicycles. This liability limitation shall not apply in cases where the customer themselves has caused the damage intentionally or as the result of gross negligence. In such cases the amount of liability claims applicable shall be determined by the actual amount and real and total value of damage incurred.
● The customer is required to have his/her own third-party liability cover. Eco Sports Limited cannot be held responsible for any third-party accidents as well as for the customers own illness, injury, or loss/damage of his/her personal belongings while using the bicycles. The customer is responsible for insurance fees including but not limited to medical cover, personal accident, loss of belongings, third party liability.
● The customer is aware that biking and E-biking, as well as the rental of biking and E-biking equipment, involves many risks, dangers and hazards including, but not limited to: mechanical failure of equipment; loss of balance; difficulty or inability to control one’s speed and direction; terrain steepness variation; rapid or uncontrolled acceleration on hills and inclines with E-bikes; variation or changes in the riding surface including rocks, gravel, cliffs, trees, roots, tree stumps, streams and creeks; changing weather conditions; exposure to temperature extremes or inclement weather; collision with pedestrians, motor vehicles, and cyclists; including the failure on the part of Eco Sports Limited to safeguard or protect the customer from risks, dangers and hazards of biking and E-Biking as a result of use of the equipment. The Customer freely accepts and fully assumes all such risks, dangers and hazards and the possibility of personal injury, death, property damage or loss resulting therefrom. The customer is solely responsible for any liability claims resulting from any actions or events occurring during the rental period or as a result thereof.
● The customer accepts liability for all costs and damages that occur due to noncompliance with their obligations as defined in these General Terms and Conditions.
● The customer cannot seek compensation or file a lawsuit against Eco Sports Limited for the damages due to any accidents that occur while the bicycles and/or equipment is rented.
● This agreement constitutes the entire agreement between the customer and Eco Sports Limited and supersedes any prior understanding or representation of any kind preceding the date of this agreement. There are no other promises, conditions, understandings or other agreements, whether oral or written, relating to the subject matter of this agreement. This agreement may be modified in writing and must be signed by both the Customer and Eco Sports Limited. By signing this agreement, the customer agrees to all Terms and Conditions and takes full responsibility for all bicycles and all supplied equipment rented out
under his/her name. The customer agrees that Eco Sports Limited has the right to terminate this agreement at any time whatsoever and take possession of all rented bicycles and equipment immediately, should the need arise.
Cancellation Terms and Conditions
Cancellation/ amendment by the participant
- Bookings cancelled within 72 hours of the scheduled activity time are non-refundable. Moreover, customers that fail to present themselves on the day of their activity (no show) will forfeit 100% of their payment.
- Bookings cancelled more than 72 hours before the scheduled activity time shall be refunded or re-booked for the next available date. Subject to availability such bookings may be amended once free-of-charge. Any subsequent amendments or cancellations will be non-refundable.
Cancellation by Eco Sports Limited
- For the safety of our customers; due to inclement weather conditions or due to events beyond our control, Eco Sports Ltd may need to cancel a booking. Eco Sports Ltd will use all reasonable endeavors to contact the customer in sufficient time to notify of the cancellation. In the event that we cancel a booking, the customer will be offered either a full refund or a booking transfer to an alternative date and/ or time.
- Eco Sports Ltd is not liable in any circumstances for any costs incurred by the participant as a result of any such a cancellation.
Transaction Fees
Stripe does not charge a fee for issuing a refund, but they do not return the original payment processing fees you paid when the transaction was first made.
